Guardianships
When an individual is unable to manage his or her personal and/or financial affairs as a result of disability, a guardianship action may be commenced, seeking to have that person declared incapacitated and appointing a guardian for him or her. A guardian steps in the shoes of the person with a disability and makes the decisions for them.
A guardian of the person can make decisions about a person’s healthcare, housing, food, clothing, and other subjects that affect the person.
A guardian of the property makes decisions about a person’s money, income, property, public benefits and other financial matters.
It may be necessary to file for Guardianship of the Property should you wish to open an ABLE account on behalf of the disabled person.
